HOW TO PURCHASE YOUR CONDOMINIUM

You have two choices

The easiest way to own property in Thailand is to purchase a condominium. As a Foreigner you can purchase in your own name. Under Thai law Foreigners are permitted to own up to 49% of the units in any condominium block. You also have to prove that the money for the purchase arrived from abroad by filling out a Tor Tor 3 forms prior to transferring the money into our account. Ask our staff and they will be more than happy to help you with this to make sure everything goes smoothly.

Thai Company

Establishing a Thai company is relatively easy, straightforward, inexpensive to operate and can be handled by reputable legal accounting firms based in Phuket. Patong Harbor View can recommend several firms to you and assist you in establishing your Thai company.

Legal Fees

Initial cost is about 30,000 baht and annual fees will be another 20,000 baht per year.

Advantages

Using a Thai entity allows foreign buyers to acquire a condominium title apartment after the 49% foreign ownership level has been reached.A Thai company is also eligible to apply to a Thai bank for mortgage finance on a Condominium, provided the company meets Bank Lending criteria. MAINTENANCE STRUCTURE

The condominium suites are sold with a condominium title. This allows a foreigner to own a property on a freehold basis. The title will be transferred to each owner upon completion of the construction and registration approval as a condominium unit by the local authorities.

The condominium Juristic Person (the CJP) will appoint Patong Harbor View, Ltd. as manager of the condominiums and provide services as listed below.

Condominium service charges are THB 50, - per m2 for 1 Br units and THB 55, - per m2 for 2 BR units and penthouses.

Service charges are calculated on the official registered square meters of each condominium and are paid annually on the first of January for the entire year. They shall be accounted for by the management company with an annual report. Purchase of condominium during the year will be pro-rated and due within 30 days after closing.

The charges cover the following services:

Estate security
Upkeep of common facilities
Pest control of common areas
Common area landscape maintenance
Cleaning and maintenance of common swimming pools
Maintenance of building exteriors
Use of the common facilities
Management of all the above
A sinking fund will be made out of the service charges of THB 5-per m2/ month

BUYING OFF PLAN - WHAT IS IT?

The concept of buying off plan (before the property is built) is not new - many investors have done it before in UK, USA and abroad. However, this trend is on the increase as more clients are beginning to realize the benefits of buying overseas property off plan.

Buying off plan means reserving a specific property or condo abroad at the initial stage when the plans are approved. It the opposite to buying a re-sale or just newly built property. A small percentage of the off plan properties for sale are offered at a discounted price to the investors to secure the bank guarantees or gain the market confidence in the project. Investing in property abroad in up and coming areas of Thailand is becoming increasingly popular as they offer larger financial rewards.

Overseas property off plan investment - How does it work?

Smart investors are getting to know about the new developments launched at the very early stage and pick and choose the best possible prices and properties. As a general rule the prices are going up during the period of construction by at least 10% when the construction commences, foundations are laid, when the rough works are finished and when the complex is completed.

As many off-plan developments last for a period of 12-24 months, the investor with a little financial outlay secures the price and in most cases enjoys a healthy capital growth if he/she chooses the right development.

Required capital to buy off-plan property abroad

A reservation fee is normally required when you buy a property off-plan; it varies from country to country and could be in the region of 100,000 baht. It is deducted from the next installment to the developer, which normally in 3-4 weeks after the reservation and in the region of 10-30%.

As the property appreciates in value it is often possible to arrange 100% mortgages and take out the cash invested to enjoy the capital growth. Overseas property investment - what should I look for?
